A number of EPS officers were sued for aggravated, exemplary and punitive damages due to an on-duty incident occurring in 2004. The plaintiff alleged that the officers entered the plaintiff's residence illegally and wrongfully prosecuted the plaintiff on charges with no reasonable grounds. -

Elkow was subject to a Disciplinary Hearing regarding allegations of Unlawful or Unnecessary use of Authority during an on-duty incident in 2004. The misconduct charges were dropped after the Presiding Officer determined that time extensions during the investigation into Elkow's misconduct were overdue and therefore null. Elkow was also sued in civil court regarding the 2004 incident. -

Rakievich was sued civilly for allegations of excessive force during a 2010 arrest. At the arrestee's 2011 trial the judge found that the arresting officers' actions were justified. -
Victim tasered by police officer who was found guilty of unneccesary use
Hoglund was subject to a disciplinary hearing regarding allegations of unlawful and unnecessary use of a taser and failing to report it during an on-duty incident occurring in 2004. He was found guilty on both counts and suspended without pay for 35 hours. -

Police officer fails to investigate death threat
A fellow EPS member filed a complaint against Werth that he failed to properly investigate a death threat in 2014. Specifically, Werth failed to properly interview individuals with respect to allegations of a death threat, prematurely concluded that the death threat was unsubstantiated and did not fulfill his duty to warn the subject of the threats. The LERB in its 2016 decision did not find WerthÕs conduct to be unreasonable. -
Victim awarded damages for excessive force during arrest
Huynh was sued in civil court for an on-duty incident which occurred in 1998, along with the other officers who arrested the Plaintiff and the EPS itself. The Plaintiff alleged that the officers who arrested her used excessive force causing physical, emotional, and mental damage. Huynh and a second officer dragged the Plaintiff along the floor when she refused to leave, and the second officer kicked her in the head. The Court found EPS liable and awarded damages. -

Hay was subject to a Disciplinary Hearing and found guilty of discreditable conduct during an off-duty incident in 2017, in which he assaulted his ex-wife. He also plead guilty to a criminal charge of assault for the same incident. -

Flavell was found guilty of Unlawful or Unnecessary Exercise of Authority during an on-duty incident in 2014. Flavell was scolded during his disciplinary hearing for being on his cell phone instead of listening to testimony. He was suspended without pay for 35 hours. -

Pullman was charged with assault for an off-duty incident in 2004 where he allegedly assaulted a youth. -
